Regulation 14 CFR Part 120 applies to all air carriers and operators certificated under part 119, Certifications: Air Carriers and Commercial Operators and authorized to conduct operations under part 121, Air Carrier Certification, or part 135, Air Carrier and Operator Certification; all air traffic control facilities not operated by the FAA or by or under contract to the U.S. Military; and all operators as defined in 14 CFR 91.147(Air Tour Operators).

Each employer's drug and alcohol testing program must ensure that all drug and alcohol testing conducted complies with the procedures in 49 CFR part 40, Procedures for Workplace Drug nand Alcohol Testing Programs.
