49 CFR part 655 states: except for a recipient operating a railroad regulated by the Federal Railroad Administration (FRA), or a recipient operating a ferryboat regulated by the United States Coast Guard (USCG), this regulation applies to each recipient and sub-recipient receiving Federal assistance under 49 U.S.C. 5307, 5309, and 5311.

Covered Employee-A person who performs a revenue vehicle operation; revenue vehicle and equipment maintenance; revenue vehicle control or dispatch (optional); Commercial Driver's License non-revenue vehicle operation; or armed security duties.
Contractor-means a person or organization that provides a safety-sensitive service for a recipient, sub-recipient, employer, or operator consistent with a specific understanding or arrangement. The understanding can be a written contract or an informal arrangement that reflects an ongoing relationship between the parties.
