What Is the FMCSA Clearinghouse?

The Clearinghouse is managed by the Federal Motor Carrier Safety Administration and requires employers and drivers to:

  • Register in the Clearinghouse
  • Conduct pre-employment full queries
  • Perform annual limited queries on current drivers
  • Report DOT drug and alcohol violations
  • Track return-to-duty and follow-up testing status

Failure to comply can result in out-of-service orders, enforcement actions, and civil penalties.

Who Must Comply?

This requirement applies to: 

  • Motor carriers employing CDL drivers 
  • Owner-operators (even with one CDL) 
  • Employers hiring CDL drivers into safety-sensitive positions 

There is no minimum fleet size exemption.

Methods NOT Allowed for DOT Alcohol Testing

DOT does not permit the following for regulated alcohol testing:

  • Urine alcohol testing
  • Saliva alcohol testing (saliva is only for initial screening, not for confirmation)
  • Blood testing (except rare post-accident law enforcement cases)
  • Handheld consumer breathalyzers
  • Instant or non-certified devices

Only DOT-approved EBT breath testing meets compliance standards.

When DOT Alcohol Testing Is Required

DOT breath alcohol testing is conducted during:

  • Random testing
  • Post-accident testing
  • Reasonable suspicion testing
  • Return-to-duty testing
  • Follow-up testing

(Some agencies also require pre-employment alcohol testing.)
