Why Employers Need a Drug Testing Program

- Drug Testing for DOT Employers
Employers regulated by the U.S. Department of Transportation (DOT) must comply with 49 CFR Parts 40. DOT refers to the federal agency responsible for regulating transportation employers. These regulations strictly define how drug and alcohol testing programs are designed, administered, and reported. DOT regulations strictly prohibit final test results based on the use of instant, point-of-collection (POC) testing, which means tests that give results immediately at the testing site, such as instant urine or oral fluid tests, for required drug testing. All DOT-mandated tests must use authorized laboratory-based methods (urine or oral fluid) and follow specific, secure collection procedures.
DOT Drug Testing Reasons
As defined in 49CFR part 40
- Pre-Employment Drug Testing
DOT regulations require mandatory drug testing for safety-sensitive transportation employees, including pre-employment, random, post-accident, and reasonable-suspicion testing. A verified negative test result is mandatory before an employee can perform safety-sensitive functions. Testing must be conducted via urine (or authorized oral fluid) at approved labs, covering specific drug panels (marijuana, cocaine, amphetamines, opioids, PCP).
- Random Drug & Alcohol Testing (minimum annual rates apply)
DOT regulations require safety-sensitive employees in all modes, such as CDL drivers in interstate/intrastate commerce, to undergo unannounced, random drug and alcohol testing throughout the year. Selections must be scientifically valid and ensure that all employees have an equal chance of being tested. Minimum annual rates are generally 50% for drugs and 10% for alcohol, though rates can fluctuate.
- Post-Accident Testing
DOT post-accident drug testing is generally required across FMCSA, FTA, FAA, and PHMSA when an incident involves a human fatality or when a safety-sensitive employee is cited for a moving violation following an accident involving disabling damage (tow-away) or immediate medical treatment away from the scene. - Reasonable Suspicion Testing
DOT regulations require employers to conduct drug or alcohol testing when a trained supervisor observes specific, contemporaneous, articulable, and documented behaviors indicating impairment. Tests must be based on appearance, behavior, speech, or odors, not “gut feelings,” and must occur near the workday.
- Return-to-Duty
DOT return-to-duty (RTD) testing is required to ensure that employees in safety-sensitive transportation positions are drug- and alcohol-free before resuming work after a violation. It is a mandatory safety requirement triggered by positive tests, refusals, or policy violations.
- Follow-Up Testing
DOT follow-up testing is a mandatory, unannounced, and directly observed regimen for safety-sensitive employees who have violated drug and alcohol regulations, have completed the SAP evaluation, and tested negative on return-to-duty testing. It ensures public safety, verifies rehabilitation, and supports compliance with 49 CFR Part 40 regulations.
